Can I ask "why" questions in an RTI, like why my application was rejected?
DraftingThe RTI Act covers information that exists on record - documents, files, notes, orders - not fresh explanations. PIOs routinely reject bare "why" questions as seeking opinions. The fix is to ask for the recorded version of the same thing: instead of "why was my application rejected?", ask for "certified copies of the notes, orders and remarks recorded on my application, including the reasons recorded for its rejection". Under Section 4(1)(d), public authorities must also give reasons for their administrative decisions to affected persons - which supports a well-framed reasons request. Framing is exactly where an experienced drafter earns their fee.
